This Criminal Petition under Section 438 Cr.P.C. is filed by petitioners - Accused Nos.2 and 3 in Crime No.37 of 2023 on the file of PS, Danthalapalli, Mahabubabad District, registered for the offences punishable under Sections 498-A, 354 A of IPC and Section 3 and 4 of Dowry Prohibition Act, seeking anticipatory bail. 2.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State.

As per the allegations made in the complaint, the petitioners/ Accused Nos.2 and 3 are the parents of Accused No.1. Accused Nos.1 to 3 have harassed the defacto-complainant mentally and physically for want of dowry.

The only allegation made against Accused No.2 as per the complaint is that on 26.06.2022, Accused No.2 during the absence of Accused No.1 alleged to have consoled the defacto-complainant by putting his hand on her shoulder and misbehaved with her. 5.
On perusal of the allegations made in the complaint, it appears prima facie, that the same do not satisfy the ingredients of Section 354A of the IPC. Since the petitioners/Accused Nos.2 and 3 are the
ASR, J Crl.P.No.4047 of 2023 parents of Accused No.1, it appears allegations are leveled against all the accused.

In view of the said facts and circumstances and considering the submissions of the learned counsel for the petitioners as well as the learned Assistant Public prosecutor, I am inclined to allow the petition, on certain conditions.

The Criminal Petition is allowed subject to the following conditions:
(i) The petitioner-accused Nos.2 and 3 shall surrender before the Judicial Magistrate of First Class, Torrur, Mahaboobabad within a period of two weeks from the date of receipt of a copy of this order; and (ii) On such surrender, the learned Magistrate shall release the petitioner-accused Nos.2 and 3 on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with two sureties in a like sum each to the satisfaction of the learned Magistrate.
