THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.29938 OF 2017 ORDER:

Petitioner claims that his grand-father worked in Indian Army and as an Ex-serviceman, he was assigned land to an extent of Ac.1.07 cents in Survey No.6/4 of Kapuluppada Village, Bheemunipatnam Taluk by proceedings dated 30.07.1961. His grand-father died on 30.03.1981. Petitioner is now in occupation and enjoyment of the subject property. According to the petitioner, he has submitted an application on 06.10.2016 to the District Collector requesting to grant 'No Objection Certificate' (NOC) for alienation of the subject property. On the basis of the said representation, report was called for by the District Collector and the Tahsildar, in turn, submitted his report in November 2016. Thereafter, no action was taken. Alleging the said inaction, the present Writ Petition is filed. 2.

If what is noticed above is correct and so far, no decision is taken, the District Collector is directed to examine the claim of the petitioner duly taking note of the report of the Tahsildar and furnish appropriate reply, as warranted by law, to the petitioner within a period of six weeks from the date of receipt of a copy of this order. If the petitioner is entitled for issuance of NOC, the same shall be furnished to him and if the petitioner is not entitled for issuance of NOC, reasons shall be assigned in support of ordering refusal.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
