HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25790 of 2017 ORDER:

The case of the petitioner is that he was issued charge memo on 16-06-2016 alleging forgery and creation of pattadar passbooks based on complaint received from one Bandari Srinivas and the petitioner has submitted explanation on 08-07-2016 and he also filed O.A.No.2834 of challenging the order dated 16-06-2016 suspending the petitioner pending enquiry and the same was dismissed. Thereafter, the petitioner filed WP.No.26958 of 2016 on 05-12-2016 against orders of dismissal of OA and said writ petition was dismissed by this Court with a direction to complete the enquiry within three months. Only enquiry officer was appointed on 01-03-2017 and though review of suspension was due on 16-06-2017, but the same was not reviewed and the petitioner is being continued under suspension. Except appointing enquiry officer, no further progress is made in the enquiry. Aggrieved by the same, the present writ petition is filed.

On the other hand, learned Assistant Government Pleader for Services submits that the petitioner was not co-operating with enquiry.

In this case, it is to be seen that suspension order was issued on 16-06-2016 and more than one year elapsed and enquiry is only at the stage of appointing enquiry officer. The specific assertion of the learned counsel for the petitioner is that order of suspension was not reviewed.

In view of the same, without expressing any opinion on merits, the competent authority is directed to undertake the review of suspension order in accordance with law and take action. There shall also be a direction to complete the enquiry, since already there is a direction by this Court in WP No.26958 of 2016 to complete the enquiry within a period of three months and take action in accordance with law.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-08-2017 Nvl
