HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.1966 of 2018 ORDER : (Oral) Vide the present petition, petitioner has challenged the docket order dated 8th March 2018, passed in I.A.CFR.No.840 of 2018 in I.A.No.667 of 2017 in R.C.C.No.5 of 2014 on the file of the learned Special Officer, Rent Control Tribunal (Principal Junior Civil Judge), Tenali, Guntur District.

Vide order dated 25th January 2018, the petitioner was directed to deposit the arrears of rent on or before 15.02.2018 and made it clear that this petition shall stand dismissed if the petitioner fails to deposit the amount and further time shall not be extended at any cost. 3.

Learned counsel appearing on behalf of petitioner submits that thereafter, the petitioner suffered with fever and jaundice and bed-ridden, due to which, he could not deposit the arrears of rent. Accordingly, through an Advocate, he approached the trial Court on 15th February 2018 for extension of time. The said application is not numbered. Therefore, the present revision petition is filed. 4.

The petitioner filed medical certificate dated 15th February 2018, whereby, the Doctor mentioned that the petitioner was taking treatment for fever and jaundice from 26th January 2018 and advised rest upto 25th February 2018. Despite that, the petition is not numbered, thus, not decided on merits.

Though the petitioner was supposed to comply the order dated 25th January 2018 upto 15th February 2018, however, not complied with it due to the reasons mentioned above.

In the interest of justice, I hereby allow this revision petition with costs of Rs.5,000/- (Rupees Five thousand) to be paid in favour of the respondent and direct the trial Court to number the application filed by the petitioner and dispose it of on merit. 7.
