ORDER:

This Writ Petition is filed for a mandamus to declare the inaction of respondent No.2 in disposing of the appeal filed by the petitioners under Section 7-D of the Estates Abolition Act, 1948 as illegal and arbitrary.

The petitioners were granted ryotwari patta in respect of Ac.1.54 cents, Ac.0.56 cents, Ac.0.63 cents and Ac.0.86 cents of land in R.S.Nos.579/1, 601/3, 601/8 and 575/6 respectively of Vallur Village, Tangutur Mandal, Prakasam District, by the Settlement Officer, Nellore, on 29.09.1980. Respondent No.3 has suo motu exercised his revisional powers and set aside the said patta vide his order, dated 10.12.2004 in R.P.No.449/85-A2. The petitioners have filed a Writ Petition questioning the said order. This Court has disposed of the said Writ Petition by giving liberty to the petitioners to file an appeal. The petitioners have filed appeal, which was registered as Appeal No.P2/291 of 2011 before respondent No.2. The grievance of the petitioners is that the said appeal is not being disposed of for the last four years.

In the light of the innocuous grievance of the petitioners, as mentioned above, respondent No.2 is directed to dispose of the appeal, if the same has not already been done, within three months from the date of receipt of this order, after notice to the petitioners and communicate final order to them.

The Writ Petition is accordingly disposed of. As a sequel to disposal of writ petition, WPMP.No.26193 of 2015 filed by the petitioners for interim relief is disposed of as infructuous. C.V.NAGARJUNA REDDY, J 6th JULY, 2015.
