THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.17349 OF 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings in FIR/Crime No.224 of 2016 on the file of Rajam Police Station, Srikakulam District, registered for the offence punishable under Section 498-A I.P.C. During hearing, Sri M. Viswanadham, learned counsel for the petitioners, requested this Court to direct the police to follow the procedure contemplated under Section 41-A of Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR1 before effecting the arrest of the petitioner.

Acceding to the request of the counsel for the petitioners, the Police, Rajam Police Station, Srikakulam District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR, referred to above, before effecting the arrest of the petitioners. Accordingly, this Criminal Petition is disposed of without deciding the merits of the case. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ___________________________________ M.
