HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4460 of 2017 ORDER:

Heard learned counsel for petitioner/ A.1 and learned public prosecutor representing the 1st respondent-State before ordering notice to 2nd respondent-de facto complainant of Crime No.55 of 2014 of CID PS, Hyderabad registered for the offences punishable under Sections 403, 406 and 420 read with Section 34 IPC and perused the grounds urged in the quash petition. 2) No doubt, the crime is pending for the past three years. The 1st respondent is directed to complete the investigation and file final report within four (04) months from the date of receipt of copy of this order. Subsequent to that, further remedies of the petitioner against the police final report, if at all aggrieved, left open.

3) Needless to say, till filing of final report, the learned Magistrate shall not insist the presence of the petitioner in the crime stage but for to issue summons, if at all, any final report filed and any cognizance taken.

4) Accordingly, the Criminal Petition is disposed of, with liberty to raise all defences in future 5) Pending miscellaneous petitions, if any, shall stand closed.
