HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.12938 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 30.03.2015, as arbitrary and illegal. Petitioner is the dealer of fair price shop No.25, Gorumanukonda Village, Bethemcherla Mandal and Post, Kurnool District. Based on the report submitted by the 4th respondent alleging certain irregularities and variations in the stocks at the time of inspection, the 3rd respondent suspended the authorization of the petitioner. Feeling aggrieved, the petitioner preferred an appeal before the 2nd respondent-Joint Collector and the same is pending. Since the appeal is pending before the 2nd respondent, this Court is not inclined to suspend the impugned order. In that view of the matter, the Writ Petition is disposed of directing the 2nd respondent-Joint Collector to hear and dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
