HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No. 9 0 4 0 of 2 0 1 8 ORDER: - When the matter is taken up, a preliminary objection with regard to the maintainability of the Writ Petition is taken by the learned Government Pleader by contending that on the impugned Order, appeal lies to the Joint Collector and the petitioner without availing such remedy, filed the present Writ Petition.
Recording the said submission and in view of the availability of the said alternative remedy, this court deems it appropriate to dispose of the Writ Petition keeping it open to the petitioner to file an appeal before the concerned authority for redressal of his grievance. If the petitioner files the appeal, the concerned authority shall dispose of the same after giving notice to all the stakeholders.
