O R D E R

Suspension pending enquiry is questioned in this writ petition. The learned counsel for the petitioner submits that charge was framed against the petitioner stating that he submitted authorization letters with forged signatures of four employees to deduct an amount of Rs.480/- towards union membership subscription for the year 2017, with the intention which constitutes serious misconduct under Reg. 28(X), (XV) and (XXXII) of T.S.R.T.C., Employees (Conduct) Regulations, 1963. He submits that documents supplied to the petitioner by the Inquiry Officer, revealed that the petitioner is in no way connected with the alleged charge and no where his name is mentioned and hence this is not a case warranting suspension pending enquiry, therefore he sought to revoke suspension.

Learned Standing Counsel for the respondent - Corporation submits that Inquiry Officer conducted inquiry and submitted report finding the petitioner guilty and the petitioner submitted his objections to the show cause notice and the same would be considered and appropriate orders would be passed in accordance with law. He submits that at this stage, no interference is warranted. This court normally would not interfere with the order of suspension pending inquiry, unless it is passed by an authority having no jurisdiction or has the smack of mala fides. In the present writ petition, both the grounds are not pleaded with any cogent material.

In view of the same, this court is not inclined to interfere with the impugned order of suspension. As the inquiry report has been submitted and the petitioner filed objections to the same, competent authority shall consider the objections and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order. Writ petition is disposed of accordingly.
