HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CIVIL MISCELLANEOUS PETITION No.504 of 2017 ORDER :

The transfer petition is filed by the petitioner/ husband under Section 24 C.P.C., to transfer M.C.No.30 of 2017 on the file of the Family Judge-cum-IV Additional District Judge, Kurnool, to the Family Court, Mahaboobnagar.

Undisputedly, earlier M.C.No.2 of 2013 filed by the petitioner/ wife was transferred to the Family Court, Mahaboobnagar by common order of this Court dated 02.12.2013 and the same when moved by S.L.P. by the wife, S.L.P. was not admitted. Though M.C. not prosecuted diligently caused dismissed for default and not even chosen to restore but for filing fresh M.C.No.30 of 2017 in the Family Court, Kurnool. Having regard to the above, M.C.No.30 of 2017 on the file of the Family Judge-cum-IV Additional District Judge, Kurnool, is withdrawn and transferred to the Family Court, Mahaboobnagar, to post said M.C. by the Judge, Family Court, Mahaboobnagar along with O.P.No.4 of 2014 and G.W.O.P.No.280 of 2012 on an even date so that there will be little convenience to the parties. Needless to say, the personal appearance of the petitioner/ husband can be dispensed with if representing through advocate unless specifically required for reconciliation or evidence etc., Accordingly, the Tr.C.M.P. is allowed.
