HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2294 OF 2017 ORDER:

The case of the petitioner is that when he approached the 4th respondent for registration of the land under plot Nos.301, 302, 303 & 304, admeasuring 1200 Sq.Yards, under Survey No.24/1 of Mattempadu Village, Nellore Rural Mandal, SPSR Nellore District, the 4th respondent refused to register the said documents vide refusal order dated 28.09.2016 only on the ground that there is an order of Status quo passed by this Court in WP.No.35108 of 2015. Aggrieved by the said refusal order, present writ petition is filed. Learned counsel for the petitioner states that the subject land is no way connected with the land claimed by the petitioners in WP.No.35108 of 2015 and that the petitioner is not a party to the said writ petition.

But, admittedly, the petitioner has alternative remedy of appeal under Section 72 of the Registration Act against the impugned order. As such, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is disposed of granting liberty to the petitioner to avail alternative remedy of appeal before the appellate authority and the appellate authority

shall dispose of the said appeal, in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
