HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5356 OF 2015 ORDER:
This Criminal Petition is filed by the petitioners/A1 to A7 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.402 of 2014 of PS, WPS, DD, Hyderabad for the offences punishable under Sections 498-A and 406 I.P.C. and Sections 4 and 6 of the Dowry Prohibition Act. Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the State, before notice to respondent No.2/de facto complainant and before admission.
Perused the material on record. As the material falls short for this Court more particularly so far as against A1 to A3 to admit the application for quashing the proceedings of the F.I.R. including investigation, this petition is disposed of giving liberty to the 1st petitioner/A1 not on bail, so far not arrested, to surrender before the learned Magistrate concerned and move for regular bail with notice to Additional Public Prosecutor. In such an event the learned Magistrate shall grant bail with necessary conditions on the same day. Insofar as A4 and A5 are concerned, even cause title of the complaint shows that they are in U.S.A. the arrest of them in taking coercive steps pending investigation is stayed and in the event of police filing final report, remedy is left open to them to approach this Court again. Needless to say, the learned Magistrate can dispense with the presence of other
accused before the Court pending investigation including of A1 at the post bail stage.
