THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17931 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the action of the respondent authorities in threatening to disconnect the power supply to petitioner's domestic service connection without there being any default and without issuing any notice, as arbitrary and illegal.

2. The grievance of the petitioner is that the petitioner's domestic service connection vide S.C.Nos.011824, 011823 and 017179 on ground floor and first floor respectively of the building premises No.19-19-1/3 at Katari Nagar, Bhimvaram is sought to be disconnected without issuance of any notice as required under Section 56 of the Electricity Act, 2003 (for short, 'the Act').

3. Sri M.Ravinder, learned Standing Counsel for the respondents would submit that action would be taken only in accordance with law.

4. Recording the submission made by learned Standing Counsel for respondent-Corporation, the Writ Petition is disposed of with a direction to the respondents not to disconnect the petitioner's service connection vide S.C.Nos.011824, 011823 and 017179 on ground floor and first floor respectively of the building premises No.19-19-1/3 at Katari Nagar, Bhimvaram, without following due process of law as required under Section 56 of the Act. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
