ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in Crime No.416 of 2026 of Uppal Police Station, Malkajgiri Commissionerate, registered for the offences punishable under Sections 78 of the Bharatiya Nyaya Sanhita (for short 'BNS') and Section 11 r/w 12 of POCSO Act-2012.

The brief facts of the case are that, on 29.03.2026, the de-facto complainant lodged a report before the police stating that the accused Sami had been harassing the victim girl, who Is aged about 18 years, by following her and forcing her to communicate with him. Despite warnings, he continued his behaviour. On 29.03.2026 at about 13:30 hrs, in the absence of the complainant, the accused came to the victim's house, threatened to upload her photos on social media, and blackmailed her. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioner for the aforementioned offences. 3.

Heard Sri Veera Babu Gandu, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that even according to the complaint dated 29.03.2026 submitted by the de-facto complainant, victim is a major. It is further submitted that the petitioner is in jail since 30.03.2026 and that the petitioner is innocent of the said

allegations. It is further submitted that the petitioner has been falsely implicated in this case and the material part of the investigation is already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposed the petition stating that, even though, on the date of filing of the report, the victim was major, the petitioner herein has followed her, when she was minor. It is further contended that the alleged offences are heinous and grievous in nature and the material part of the investigation is not yet completed. It is further contended that if the petitioner is released on bail, at this stage, there is a possibility of every threat to the de-facto complainant. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 30.03.2026, who is arrayed as accused and as seen

from the record, as on the date of registration of FIR, the victim was major and the material part of the investigation was already completed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions.

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties for a like sum each to the satisfaction of the learned VI Additional Metropolitan Magistrate, Medchal-Malkajgiri District at Mediaplly.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
