THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.20800 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking to declare the action of 3rd respondent in proceeding with E.A.No.5 of 2013 in C.C.No.1020 of 2010 pending disposal of F.A.SR.No.843 of 2015 before the 2nd respondent, as illegal and arbitrary.

Petitioner has filed the aforesaid appeal before the 2nd respondent - State Commission aggrieved by the orders passed in the aforesaid E.A., but as there is no President appointed for the State Commission, the same could not be taken up and as such, the present Writ Petition is filed.

It is submitted by the learned counsel for petitioner that as the State Commission is functioning now, the Writ Petition be disposed of by permitting the petitioner to pursue the appeal, by extending the interim order, dated 07.09.2015, passed by this Court.

As the State Commission is functioning now, in view of the request made by the learned counsel for petitioner, we deem it appropriate to dispose of the Writ Petition by

permitting the petitioner to pursue the appeal filed before the State Commission. Further, the interim order passed by this Court on 07.09.2015 shall continue to operate for a further period of six (6) weeks from today.

Subject to the above, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
