Janga Raghava Reddy v. State Of Telangana, Revenue Department

2019-06-07Sanjay Kumar2 pages

THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11028 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Kazipet Mandal, Warangal Urban District, did not include his land admeasuring Ac.1.05 guntas in Survey No.483/B/2 of Madikonda Revenue Village, Kazipet Mandal, Warangal Urban District, in the new pattadar pass book issued to him and also in the online pahani.

Perusal of the record reflects that the petitioner was issued a regular pattadar pass book under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, wherein the subject land was also included. Despite the same, it appears that while issuing a new e-patta pass book in terms of the Government's policy, the Tahsildar concerned left out this land holding of the petitioner. The petitioner made a representation on 10.06.2018 to the Tahsildar, Kazipet Mandal, pointing out this lapse on his part and requiring the needful to be done. The said representation was received by the Tahsildar's office on 11.06.2018 but as no action was taken thereupon, the petitioner is before this Court.

As a comprehensive e-patta pass book would be essential for the petitioner to avail the benefit of Government's Rythu Bandhu Scheme, the Tahsildar concerned ought to have been more diligent while issuing the epatta pass book to him on the strength of the regular pattadar pass book. The writ petition is accordingly disposed of directing the Tahsildar, Kazipet Mandal, Warangal Urban District, to take appropriate action upon the petitioner's representation dated 10.06.

event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:07.06.2019 GJ
