THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13216 OF 2016 ORDER:

This writ petition is filed to declare the proceedings issued by the Respondent No.2 vide default notice No.109164/PMU/ES/2006 dated 26.11.2015 as illegal, arbitrary, and against the principles of natural justice and consequently set-aside the impugned proceedings.

Considering the fact that there is an arbitration clause in the agreement, petitioners seeks to withdraw the writ petition with liberty to pursue the application filed before the Court under Section 9 of the Arbitration and Conciliation Act.

Permission is accorded.

Accordingly, the writ petition is dismissed as withdrawn with liberty as prayed for. No order as to costs.
