HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 25679 of 2011 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not disposing of the representation of the petitioners dated 28.07.2011, as illegal and arbitrary.

The case of the petitioners 1 to 4 is that they got land to an extent of Acs.3.71 cents in S.No.123/1, Ac.0.03 cents in S.No.123/3, Acs.5.40 cents in S.No.125 and Ac.1.80 cents in S.No.126 situated at Padmanabharajupeta, Yelamanchili Mandal, Visakhapatnam District, respectively, by inheritance and are in possession and enjoyment of the same by paying the land revenue to the Government. It is stated that as the 1st respondent did not issue pattadar passbooks and title deeds in their favour, the petitioners made a claim before the 1st respondent on 18.07.2011 seeking an enquiry for issuance of pattadar passbooks and title deeds. As there was no proper response, the petitioners made a representation dated 28.07.2011 to the 1st respondent. But till date, no action has been initiated. Questioning the same, the present writ petition is filed.

No counter is filed by the respondents denying the averments made in the writ petition. But, the learned Government Pleader, on instructions, submits that he has no objection for passing orders on the representation made by the petitioner, in accordance with law, if the

same is still pending consideration.

Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of, directing the 1st respondent to consider and dispose of the representation dated 28.07.2011 made by the petitioner, in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of the order, if the same is still pending consideration. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any in the writ petition shall stand dismissed.
