HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9097 OF 2018 O R D E R :

This writ petition is filed challenging the proceedings dated 13.03.2018 issued by the 2nd respondent initiating disciplinary proceedings against the petitioner alleging unauthorized absence. Learned counsel for the petitioner submits that though the petitioner filed WP.No.26018/2016 challenging his transfer to Narayanakhed, Medak District, and though this Court granted Status quo, again he was transferred to the same place. He also submits that he was already punished, as such, initiation of disciplinary proceedings is bad.

On the other hand Sri N.Bhupal Reddy, learned Standing Counsel for respondent No.2 submits that since petitioner was absent unauthorisedly, disciplinary proceedings have been initiated. He also submits that charge in earlier case was different and when petitioner challenged the earlier proceedings dated 15.09.2017, this Court has dismissed the MP.

It is to be seen that normally this Court will not interdict initiation of disciplinary proceedings, unless the same is without jurisdiction. In this case, learned counsel for the petitioner was not able to point out whether the authority lacks in jurisdiction for initiating disciplinary proceedings.

It is only initiation of proceedings, no order affecting petitioner's services is passed. In

view of the same, it is open for the petitioner to raise all his objections raised here, before the authority within a period of two weeks from the date of receipt of a copy of this order and on such objections the authority is obligated to consider the same. Petitioner has alternative remedy in case if any order is passed. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
