THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6267 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "This Hon'ble Court may be pleased to declare the action of the 2nd respondent Municipality in not giving benefit of the Goodwill amount and monthly rent payable to shop No.2 allotted to the Petitioner on par with the other allottees pursuant to the Resolution No.606 dt.18-4-2013 as illegal, arbitrary and unjst by issuing a writ, order or direction more particularly one in the nature of mandamus and further direct the 2nd respondent to consider the case of the petitioner by extending the benefit of the Municipal Resolution 606 dt.18-4-2013 in respect of Shop No.2 situated at Municipal TB complex, Proddatur, YSR Kadapa District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case in the interest of justice."
The petitioner's representation dated 07.01.2016 seeking extension of the benefits under the Resolution dated 18.04.2013 is stated to be pending consideration before the Proddatur Municipality. Sri Mohd. Saleem, learned Standing Counsel for the respondent - Municipality, states, on instructions, that the afore-stated representation would be considered and appropriate action would be taken thereon.
In that view of the matter, the writ petition is disposed of at the admission stage directing the 2nd respondent - Municipality to consider the petitioner's representation dated 07.01.2016 in accordance with law and in the light of the Resolution dated 18.04.2013 and take appropriate action thereon. In the event the petitioner's request for extension of the benefits is rejected, the reasons therefor shall be recorded and duly communicated to him. This entire exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
