THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2795 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in connection with Crime No.339 of 2021 on the file of Station House Officer, Medak Town Police Station, Medak District registered for the offence punishable under Section 306 of Indian Penal Code (I.P.C.) 2.
Heard the learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Petitioner is arrayed as sole Accused in the aforementioned Crime registered for the offence under Section 306 of IPC. 4.
The facts of the case are that on 21.12.2021 the wife of the deceased filed a complaint against this petitioner stating that her deceased husband namely Sanda Venkatesh and the petitioner herein were lecturers in Government Junior College, Veldurthi. The petitioner filed complaint against her deceased husband, resulting in
the police inquiring about the same. On 19.01.2022 police sent a requisition to Nodal Officer to call for the CDRs pertaining to six phones numbers i.e. 9908812627, 9959111648, 8096927218, 9441294537, 9985902627 and 9553243456 which were used by the deceased, accordingly, the phone numbers were analyzed and the police also concluded that the deceased was in fact involved in harassing this petitioner/Accused. However, finding of the police was on 08.02.2022 and the deceased died on 21.12.2021. 5.
It is seen from the police investigation that the petitioner herein was a victim in the hands of the deceased and the deceased had indulged in acts attracted the offence under Section 354-D of IPC. In the said circumstances, the petitioner/Accused can be released on Anticipatory Bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused is directed to surrender before the Station House Officer, Medak Town Police Station, Medak District, within a period of fifteen (15) days from today, and on such surrender, the said Station House Officer shall release the
petitioner/Accused on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties to the like sum each to his satisfaction ii) The petitioner/Accused shall appear before the investigating authorities as and when required.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
