THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.11698 OF 2019 ORDER:

This Writ Petition is filed with the following prayer:- "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleaded to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the high handed action of the 3rd respondent in interfering with the life, personal liberty and property of the petitioners, as well family disputes of the 1st petitioner and his daughter, forcing the petitioners to transfer an amount of Rs.15,000/- monthly in favour of the Respondent Nos.4 to 6 and threatening them to implicate in false criminal cases under the instigation of the respondent Nos.

4 to 6 is highly illegal, arbitrary, unjust, unconstitutional and in violation of principles of natural justice and also in violation of Articles 14, 19 and 21 of the Constitution of India and consequently, direct the respondents not to interfere with life, personal liberty and property of the petitioners as well family disputes of the petitioner No.1 and to grant such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned Assistant Government Pleader produced written instructions stating that on the complaint the fourth respondent dated 18.04.2019, a petty case was registered under Sections 510 and 323 of the C.P. Act of Meerpet Police Station. The accused persons also paid fine of Rs.510/- as imposed by the Court below in STC.No.1806 of 2019 dated 22.04.2019. It is also stated that both the parties have undertaken before the Inspector of Police, Meerpet, on 18.04.2019 stating that they would not interfere in each others' issues. The allegation that the third respondent threatened the first petitioner to transfer an amount of

Rs.15,000/- per month from his pension to fourth respondent is denied. On 03.06.2019, the fourth respondent gave complaint stating that on 15.04.2019 her brother came to her house and beat her children and behaved indecently with her. G.D. entry was also made in this regard. The fourth respondent is informed to settle the matter before the concerned Court. A petty case was registered against the second petitioner.

Recording the abovementioned instructions, this Writ Petition is disposed of directing the police not to interfere with the life, personal liberty and property of the petitioners except in accordance with law.
