HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No. 184 of 2016 ORDER:

This petition is filed to withdraw C.M.A.No.9 of 2015 from the file of Senior Civil Judge, Rajam, Srikakulam District, and transferred to this Court to be tried along with C.R.P.Nos.2069 and 2277 of 2015.

2. According to affidavit filed in support of transfer C.M.P., petitioners herein filed O.S.No.123 of 2005 before Junior Civil Judge, Rajam, for declaration that they are absolute owners of the property and the suit was decreed and respondents preferred A.S.No.16 of 2007. As some of plaintiffs died, I.As. were filed to bring the legal representatives on record and those applications were dismissed, against which two revisions are filed before this Court and one appeal is preferred before Senior Civil Judge, Rajam and these matters have to be decided by one Court, therefore, C.M.A.No.9 of 2015 pending before Senior Civil Judge, Rajam, has to be withdrawn and transferred to this Court.

3. Respondents in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioners.

5. Considering the reasons stated in the affidavit, C.M.A.No.9 of 2015 is withdrawn from Senior Civil Judge, Rajam, Srikakulam District, and transferred to this Court to

be tried along with C.R.P.Nos.2069 and 2277 of 2015.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
