THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.828 of 2014 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in C.C.No.293 of 2012 on the file of VI Additional Chief Metropolitan Magistrate, Hyderabad arising out of a Crime No.9 of 2010 Cyber Crime Police Station, CID, Hyderabad, registered for the offences punishable under Sections 66(A), 67, 67-B (c)(d) of Information Technology Act, 2000 and Section 509 IPC. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

After arguing for some time, the learned counsel for the petitioner/accused fairly stated that already three witnesses were examined and the case is pending for the past three years and requested the Court to direct the trial Court to dispose of the case as early as possible.

Considering the facts and circumstances of the case and in view of the submission of the learned counsel for the petitioner/ accused the learned VI Additional Chief Metropolitan Magistrate, Hyderabad is directed to dispose of C.C.No.293 of 2012 pending on his file as expeditiously as possible, preferably on or before 2907-2016. However, the presence of the petitioner/accused is dispensed with except on the dates when his presence is specifically required for the purpose of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. Accordingly, the criminal petition is disposed of. As a

sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
