THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8244 of 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-2 under Section 482 Cr.P.C. challenging the order, dated 23.05.2016, in Crl.M.P.No.867 of 2016 in R.C.No.26(A) of 2015, passed by the Principal Special Judge for CBI Cases, Hyderabad. Heard and perused the material available on record. While grating bail to the petitioner/A-2 on 23.05.2016, the Court below directed the petitioner to execute personal bond for a sum of Rs.2,00,000/- with two sureties for the like sum each. Aggrieved over the condition of executing personal bond for Rs.2,00,000/- with two sureties, the petitioner filed the present petition. Learned counsel for the petitioner submitted that the petitioner, being from a poor family and being illiterate and car driver by profession, is not in a position to pay the surety amount.

Learned counsel further submits that since the petitioner could not able to produce that much amount of surety, the petitioner is still in the prison and not granted bail and that the main accused is already released on bail on execution of a bond for a sum of Rs.1,00,000/-. Having heard the learned counsel for the petitioner and having perused the material available on record, this Court is of the view that the condition of executing a personal bond for Rs.2,00,000/- with two sureties, imposed against the petitioner by the Principal Special Judge for CBI Cases, Hyderabad, vide order, dated 23.05.2016, in Crl.M.P.No.867 of 2016 in R.C.No.

The petitioner is directed to execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the like sum each.

The other conditions in the order of the learned Principal Special Judge shall stand unaltered.

With the above modification, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
