THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.19501 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue Writ of Mandamus to declare the action on the part of the 3rd respondent police in calling the petitioner to the Police Station time and again and insisting upon her to settle the dispute which is subject matter of the suit in O.S.No.137 of 2015 on the file of the Hon'ble Principal Junior Civil Judge, Warangal as illegal, arbitrary, unjust apart from violative of principles of natural justice and against the powers vested in the respondent police; and to consequently direct the respondent police not to interfere in the civil dispute which is subject matter of O.S.No.137 of 2015 on the file of the Hon'ble Principal Junior Civil Judge, Warangal, in any manner." Heard Sri Nandigam Krishna Rao, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 06-07-2015 furnished by the Sub-Inspector of Police, Atmakur Police Station have been placed on record by the learned Government Pleader for Home appearing for respondents. It is stated in the said written instructions that on receipt of a private complaint filed by one Sri Potlapally Veerabhadra Rao, S/o.Veerender Rao, R/o.Hanamkonda from the Court of I Addl. Judicial Magistrate of First Class, Warangal stating that one
Akuthota Sunitha and 12 others had created false documents with an intention to cheat the complainant and entered into the revenue records a case in Crime No.202 of 2012 under Sections 120 (b), 420, 480, 468, 199, 200 and 120 of I.P.C. is registered on the file of Atmakur Police Station, Warangal District and the petitioner herein is shown as A7 in the said crime. It is further stated that police completed the investigation and there is ample evidence that all the accused, A1 to A12 including the petitioner herein had committed the offences mentioned in the First Information Report. It is also stated that after completion of investigation, the investigating agency, filed charge sheet against A1 to A12 including the petitioner herein (A7) before the Court of I Addl.
Judicial Magistrate of First Class, Warangal and the same has been taken on file vide C.C.No.864 of 2014. It is also stated in the said written instructions that except conducting the investigation in the above case against all the accused including the petitioner (A7) herein, this respondent never interfered with the subject lands in question. It is also stated that on coming to know of the filing of the charge sheet against the petitioner herein (A7), the petitioner rushed to this Court and filed the present writ petition with false and baseless allegations. It is also stated that except the above case, no fresh case or complaint has so far been received against the petitioner herein and she is not at all required in any case except the above.
On noticing the said written instructions, dated 06-07-2015 furnished by the Sub-Inspector of Police, Atmakur Police Station, learned counsel for the petitioner has requested this Court to record the said written instructions and dispose of the
writ petition.
In view of the above, this writ petition is disposed of, by recording the written instructions, dated 06-07-2015 furnished by the Sub-Inspector of Police, Atmakur Police Station. It is also made clear that police authorities shall not interfere with the civil matters, except in accordance with law. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
