HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.1619 of 2017 ORDER : (Oral) Vide the present petition, petitioner has assailed the order dated 10.11.2016, passed in I.A.No.1258 of 2016 in I.A.No.782 of 2016 in FCOP.No.180 of 2014, whereby, the application filed by the petitioner to receive the rejoinder on counter affidavit filed by the respondent, was dismissed.

Admitted case of the petitioner is that respondent filed counter affidavit on 27.08.2014, however, I.A.No.1258 of 2016 was filed on 22.09.2016. Moreover, the proposed rejoinder contains explanation and continuation of petition averments and nothing more than that. It is not necessary to file rejoinder to every counter affidavit until and unless a specific averment is to be denied by the petitioner. In view of above, I find no illegality or perversity in the order dated 10.11.2016. Finding no merit in the instant petition, the same is accordingly dismissed. No order as to costs.
