HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6458 OF 2009 ORDER:

This writ petition is filed seeking a direction to the respondents 1 to 4 to permit the petitioner to catch fish in Peddacheruvu Tank of Vemulakonda Village, Valigonda Mandal, Nalgonda District.

Heard Sri K. Bhima Singh, learned counsel for the petitioner and the learned Government Pleaders for Fisheries and Revenue (T.G.) A counter-affidavit has been filed by the 3rd respondent stating that Pandiri Srinivas was the highest bidder and he was given orders for catching the fish and all the necessary arrangements were made for catching the fish in the tank in question, but the President, Fishermen Cooperative Societies approached this Court and this Court in W.P.M.P.No.7625 of 2009 in W.P.No.5832 of 2009, passed an interim order on 19.03.2009, which reads as follows:

"There shall be interim direction to the respondents to consider issuing fishing orders to the fishermen cooperative society, Vemulakonda Village, Valigonda Mandal, Nalgonda District for the year 2008-09. However, the society shall conduct fishing operations under the supervision of any of the officer nomination by the authorities and shall deposit the sale proceeds into any nationalished bank".

Further, this court by order dated 30.03.2009 in W.P.M.P.No.8427 and 8701 of 2009 in W.P.No.6458 of 2009 filed by the petitioner viz., P. Srinivas, S/o. Mallaiah, while dismissing both the W.P.M.Ps, finding no reason to grant the relief. However, this will not preclude the petitioners from filing any objections before the officers those who are supervising the fishing operations as to the rate of sale of fish in the market."

There is no reply affidavit filed by the petitioner denying the averments made in the counter-affidavit.

In that view of the matter and considering the fact of very reason for which the relief has been claimed is over, nothing survives in the writ petition. Accordingly, the writ petition is closed. There shall be no order as to costs.
