HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45277 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in C.C.No.378 of 2016 on the file of the V Additional Judicial First Class Magistrate, Kakinada, East Godavari District. 2.

Heard and perused the material available on record. 3.

The petitioners are alleged to have committed the offence punishable under Sections 498-A r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Considering the facts and circumstances of the case and the stage of the proceedings, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioners prayed that the presence of the petitioners before the trial Court may be dispensed with. 5.

In view of the above submission, the presence of the petitioners before the trial Court is dispensed with except on the dates when their presence is specifically insisted by the trial Court. The petitioners are directed to be represented by a Counsel before the trial Court on all hearing dates.
