HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11273 of 2019 ORDER:
The grievance of the petitioners is that the Tahsildar, Tandur Mandal, Mancherial District, is not considering their application for grant of a pattadar passbook in relation to their assigned land in Sy.No.972 of Achalapur Village, Tandur Mandal, Mancherial District.
It appears that the petitioners claim rights over the subject land by virtue of the e-patta certificates issued to them as long back as in the year 2005. The record reflects that the petitioners have not made an application in the prescribed format in Form VI (A) as required by Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989 for mutation being effected in their favour in the revenue records in relation to the assigned land. Without adhering to the prescribed procedure, it is not open to the petitioners to complain of inaction on the part of the revenue authorities. The Writ Petition is accordingly disposed of permitting the petitioners to submit an application in Form VI (A) along with the requisite fee and necessary documents. In the event such an application is filed, the Tahsildar, Tandur Mandal, Mancherial District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of such application.
Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 11th June, 2019.
