HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9071 OF 2018 O R D E R :

This writ petition is filed against the order dated 13.03.2018, whereby the petitioner was transferred and posted to work under the control of Superintending Engineer/Operation/ Komurambheem (Asifabad), on the ground of initiation of disciplinary proceedings against the petitioner. Learned counsel for the petitioner submits that petitioner is not responsible for the laches as he is working in accounts department; that the irregularity is said to have been done in Jainoor section and the petitioner is working at Adilabad which is 75 Kms. away from Jainoor; and as such, there is no need for the respondents to issue transfer orders to the petitioner. On the other hand Sri Zakir Ali Danish, learned Standing Counsel for respondents submits that since there are allegations against the petitioner, instead of suspending him he was transferred.

It is to be seen that the truth or otherwise of the allegations made against the petitioner can be gone into the enquiry. Normally, this Court will not interfere with the order of transfer by exercising the power of judicial review. More so, in this case, disciplinary proceedings are pending against the petitioner. As such, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
