THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36476 OF 2015 O R D E R :

Heard counsel for the petitioner and Government Pleader for Forests appearing for respondents.

2. Petitioner's tractor and plough were seized by the respondents. Aggrieved thereby, he had approached this Court by way of W.P.No.32667 of 2015 which was disposed of on 14.10.2015 directing the respondents 2 and 3 to produce the same before the competent Court, giving liberty to the petitioner to file appropriate application in the competent Court for release of the vehicle, since it was pointed out that a POR No.46/84 was booked against the petitioner.

3. Although counsel for petitioner states that no case was booked and that when the petitioner approached the Court of Judicial First Class Magistrate, Sattupally, the said Court returned the same on 19.10.2015 saying that the petition is premature and only after the vehicle is deposited by the Forest Department, the petition would be entertained, the learned Government Pleader for Forest states that POR mentioned above was in fact booked against the petitioner but the vehicle is with the District Forest Officer, Khammam.

4. Therefore, this Writ Petition is disposed of directing the petitioner to approach the District Forest Officer, Khammam for release of the vehicle as well as plough. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
