HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9070 OF 2018 O R D E R :

This writ petition is filed against proceedings in Memo No.CMD/CGM(HRD)/GM(S)/AS-DC/PO-L/F.No.594-D2/18-1, dated 12.03.2018 wherein and whereby the petitioner who was working as Additional Assistant Engineer (Operations), Indravelli, Adilabad Circle, Adilabad District, was transferred and posted to work under the control of Superintending Engineer/Op/Warangal. Learned counsel for the petitioner submits that there are three superior officers above the petitioner and three subordinate officers below the petitioner; that the petitioner is not at all responsible for the alleged irregularities and that the petitioner has issued memo to the concerned line inspector who committed irregularities, but he has not given any explanation till date.

He further submits that the respondent instead of taking action against the said Lineman promoted him as Line Inspector. He also submits that transferring the petitioner to the place which is situated 450 K.Ms. away from the present place is arbitrary as his wife is working at Utnoor, Adilabad District.

suppressing the readings; and that to see that there should not be any influence on the enquiry, petitioner was transferred. It is to be seen that basing on the allegations petitioner was transferred. The truth or otherwise of the allegations cannot be gone at this stage in the present writ petition. It will be gone into the enquiry to be initiated. Since petitioner alleges that his wife is working at Utnoor, and since the place to which the respondents transferred the petitioner is 450 K.Ms. far away from the present place, he can make an application to the competent authority seeking posting to some other place.

Having regard to the aforesaid facts and circumstances, I do not see any reason to entertain the writ petition. However, the petitioner is granted liberty to make representation to the competent authority seeking transfer to some other place and on such application being made by the petitioner, the competent authority shall consider the same and dispose of the said representation, in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
