O R D E R

St. Anthony's High School (English Medium), St. Anthony's Upper Primary School (Telugu Medium), St. Anthony's Primary School (English Medium), are petitioners in this writ petition, represented by their correspondent.

Common grievance of the three writ petitioners is that request was made on 11.11.2016 seeking permission of the competent authority to fill up the vacant aided posts both by way of direct recruitment and promotion. So far no permission is granted and on account of the delay in granting permission, teaching is affected, as there is dearth of teaching faculty in the petitioners' schools.

The learned counsel for the petitioners would submit that the inaction on the part of the respondents is deliberate and because of their inaction, much inconvenience is being caused to the management of the schools. He submits that direction be issued to grant permission sought for in the representation made on 11.11.2016 individually by the three writ petitioners, by the competent authority and accord sanction as early as possible.

The learned counsel for the petitioners further submit that for the first petitioner, the 3rd respondent - Regional Joint Director of School Education, is the competent authority and for petitioners 2 and 3, the 4th respondent - District Educational Officer is the competent authority. However, with reference to the grant of permission by the Regional Joint director of School Education for the 1st petitioner, proposals have already been submitted by the District Educational Officer.

Heard the learned Government Pleader for School Education for the respondents.

Having regard to the submissions, without expressing any opinion on merits, the writ petition is disposed of directing the Regional Joint Director to examine the proposals said to have been submitted by the District Educational Officer on the claim of the 1st petitioner and take decision as warranted by law, within a period of four weeks from the date of receipt of a copy of this order.

The 4th respondent - District Educational Officer is directed to examine the proposals submitted by petitioners 2 and 3 and pass orders as warranted by law within a period of four weeks from the date of receipt of a copy of this order.
