HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2096 of 2014 DATED : 17.02.2016 Between:

Kancharana Raghu S/o.Late Sitaramayya & others.

.. Petitioners AND Sri S. Ramakrishna Dasu, The Sub-Registrar, Stamps and Registration Department, Dwarakanagar, Visakhapatnam.

.. Respondent

The Court made the following:

HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2096 of 2014 ORDER:

In this contempt the petitioners allege that the order passed by this Court on 22.04.2014 is not complied and therefore, the respondent has committed contempt of the orders of this Court.

2. In the counter affidavit filed on behalf of the respondent, it is specifically averred in Para No.6 that no document is presented by the petitioners before the Registrar and no amount is deposited towards stamp duty and registration fee in the designated Bank. Therefore, the question of non-compliance of the directions of this Court does not arise.

3. No material is placed before this Court to show that even though the petitioners have presented the documents, but the Registrar refused to receive and thereby violated the order passed by this Court. Therefore, I do not see any justification to take further action against the respondent under the Contempt of Courts Act.

4. Hence, the Contempt Case is closed. However, it is needless to observe that as and when the documents are presented, the respondent authorities are bound to process the same as directed by this Court. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
