THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL R.C.M.P. No.3567 OF 2015 AND CRIMINAL REVISION CASE No.2447 OF 2015 ORDER:

The Crl.R.C.M.P. No.3567 of 2015 is filed to condone the delay of (2241) days of delay in filing the revision case. The Crl.R.C. (SR) No.36360 of 2015 is filed against the docket order, dated 20.05.2015, passed in C.C. No.103 of 2008 by the Additional Judge cum XIX ACMM, Hyderabad.

Heard and perused the material available on record. Normally, this Court entertains the application for condone delay, after issuance of notice to the respondents.

When the matter is taken up, learned counsel for the petitioners submitted that though the accused filed an application under Section 317 Cr.P.C., the Court below dismissed the said application on the ground that there was no representation on behalf of the petitioners and issued NBWs against them. He further submitted that the petitioners are ready to appear before the Court below and face the trial, and therefore, the NBWs may be recalled.

In view of the submissions made by the learned counsel for the petitioners, this Court is inclined to pass the following order: In the result, Crl.RC MP No.3567 of 2015 is allowed and the Criminal Revision Case is disposed of directing the petitioners to approach the Court below on or before 30.10.2015 and file an application to recall the NBWs issued against them and on filing of such application, the Court concerned is directed to recall the

NBWs issued against the petitioners on the same day on condition of petitioners executing personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) each with one surety for the like sum each and also to appear before the Court concerned on all hearing dates. In case, the petitioners failed to comply the condition of appearance before the Court concerned, either by person or through an Advocate, the Court concerned is at liberty to proceed in accordance with law. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J October 08, 2015.
