O R D E R

As per the averments made in the writ petition, petitioners are Government recognized schools and certain posts in their schools were admitted into grant-in-aid. Appointment of staff in aided institutions is governed by Rule 12 of G.O.Ms.No.1 Education (PS-2) Department dated 01.01.1994. Vide memo dated 20.10.2004 Government imposed ban on recruitment and subsequently, vide memo dated 04.01.2017, it was lifted. Petitioners sent proposals on 17.02.2018 to respondents 3 to 5, seeking permission to fill the vacant aided posts. Aggrieved by the inaction of the said respondents in processing the proposals sent by the petitioners dated 17.02.2017 and permitting them to fill the vacant aided posts in terms of Rule 12 of G.O.Ms.No.1 dated 01.01.1994, the present writ petition is filed.

Learned counsel for the petitioner submitted that this court in similar facts and circumstances in W.P.No.29729 of 2017 dated 04.09.2017 directed the competent authority to consider the proposals sent by the petitioner therein in accordance with Rule 12 of G.O.Ms.No.1 dated 1.1.1994, and that similar order may be passed.

Learned Assistant Government Pleader for Education appearing for the respondents does not dispute the same.

In view of the above facts and circumstances and the submissions of the learned counsel, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to consider the

proposals dated 17.02.2018 submitted by the petitioner in accordance with Rule 12 of G.O.Ms.No.1 dated 1.1.1994 and take action accordingly.
