THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17828 OF 2016 ORDER:

This writ petition is filed questioning the action of the respondents 2 and 3 in not disposing of the representations of the petitioner. The grievance of the petitioner is that he has submitted two representations dated 15.10.2015 and 12.11.2015 to the 3rd respondentPanchayat Secretary with regard to certain encroachments made by certain people belonging to Dargapet and Penukonda Villages, but no action was taken so far.

Heard the learned counsel for the petitioner and Sri G. Seshadri, learned standing counsel for the respondents. Inasmuch as the petitioner only seeks his representations to be considered and disposed of, the respondents shall take into consideration of the allegations made by the petitioner and if they are found to be true, necessary action as enjoined under the Panchayat Raj Act (for short, "the Act") shall be taken forthwith after affording the opportunity of hearing to the petitioner.

Accordingly, the writ petition is disposed of with a direction to the respondents to take into consideration of the representations dated 15.10.2015 and 12.11.2015 of the petitioner and dispose of the same in accordance with the provisions of the Act forthwith by affording an opportunity of hearing to the petitioner. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
