This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the 4th respondent in interfering in civil disputes and demanding the petitioners to visit to the police station and forcing to settle the civil disputes in the police station is arbitrary, illegal and against to the principles of law and against to the fundamental rights consequently direct the 4th respondent not to interfere in civil disputes and not to obstruct the construction work of petitioners in the said plots No. 117 86 118 in Sy.Nos. 146, 147 86 148 Sripuram Housing Colony Nagaram Village, Keesararn Mandal R.R.Disrtict."
Heard Sri Mohd. Mumtaz Pasha, learned counsel for the petitioners and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 04-08-2015 furnished by the Sub-Inspector of Police, Keesara Police Station, Ranga Reddy District have been placed on record by the learned Government Pleader for Home and the said instructions read as under: "It is respectfully submitted that as per the records, as of now, no complaint whatsoever is received or registered against the petitioner herein on the file of Keesara Police Station, Cyberabad Commissionerate. It is submitted that the allegation of the petitioner that while they were filling the sand in the said basements in their plots, the 4th respondent came to their property and started interference in their construction work unlawfully and causing unlawful obstructions in their construction works, the 4lh respondent herein on 21.7.
2015 came to their property and caused the unlawful obstructions to do the work and demanded him and other petitioners to come to the police station and accordingly, they approached this respondent police station and at the instance of some local leaders and land grabbers forcing him and other petitioners to settle the matter in the police station is absolutely false, baseless and hence denied.
It is submitted that the allegation of the petitioner that the 4th respondent acting at the instance of the some local leaders, land grabbers and also at the instance of one Police Inspector happens to be his friend again and again causing obstructions to their work on their property and demanding them to visit the police station time and again and forcing them to settle the property dispute in the police station and that the 4th respondent again on 23.7.2015 at about 11. per the instructions of the 4l respondent, they approached this respondent police station and at the instance of the local leaders and land grabbers forced him and other petitions to settle the matter with them and asked the petitioners to wait at the police station till midnight and lastly warned the petitioners to settle the dispute in the police station on or before 26.7.2015 otherwise they have to face severe consequences. It is pertinent to submit that as of now, this respondent never summoned the petitioners to the police station nor asked them to settle the matter with the alleged land grabbers and local leaders. I humbly submit that this respondent never interfered with the civil disputes. This respondent never visited the subject property of the petitioners herein.
As a precautionary measure, to prevent the police from taking any action in the event of lodging of any complaint, the petitioners rushed to this Hon'ble Court and filed the present writ petition with false and baseless allegations. On mere apprehension, the petitioners filed the present writ petition." On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and close the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 04-08-2015 furnished by the Sub-Inspector of Police, Keesara Police Station, Ranga Reddy District.
