HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.9095 of 2018 ORDER:

This writ petition is filed seeking the following relief: "..to issue a Writ, Order or direction more in the nature of Mandamus declaring the action of the Official Respondents in not conducting any Investigation after registering FIR No.226 of 2016 dated 22.11.2016 on the file of the Police Station at Giddalur under Section 3(1)( r) (s) of the SC, ST (POA) Act, 2015, against the respondents is illegal, arbitrary and consequently direct the Respondents forthwith to complete the Investigation and to take all actions in pursuance to the Registration of FIR No 226 of 2016 dated 22.11.2016 including causing arrest of the accused and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and learned Government Pleader for Home (A.P.). Perused material record. 3.

Learned counsel for the petitioner submits that the only grievance of the petitioner is that despite registration of the subject crime in FIR No.226 of 2016, no investigation is done on proper lines and no charge sheet is filed till date. 4.

Learned Government Pleader for Home, on written instructions, submits that investigation was duly conducted as per the procedure established by law and that the opinion of the Investigating Officer i.e., Sub Divisional Police Officer, Markapur, is submitted to the Inspector General of Police, South Coastal Zone, Guntur Range, Guntur, vide letter dated 13.03.2018 seeking necessary permission for filing an appropriate report and that permission is awaited from the said Officer and that as and when permission is granted,

appropriate final report would be submitted before the Court concerned.

Recording the said submissions, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
