HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11102 of 2019 ORDER:

The grievance of the petitioners is that the District Collector, Nizamabad District, is not disposing of their Revision Petition filed under Section 9 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. This Revision was purportedly filed by them against the order dated 21.02.2019 of the Tahsildar, Nizamabad (South Mandal), Telangana.

However, perusal of the record reflects that the said Revision was a handwritten communication addressed to the District Collector, Nizamabad District. No grounds have been set out in this communication which reads more like a letter. In this regard, reference may be made to Rule 23 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, which provides that a Revision under Section 9 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, should be made in writing and set forth concisely the grounds thereof. The revision petitioners are also required to pay a court-fee stamp of Rs.5/-.

In that view of the matter, it is clear that the petitioners' so-called Revision is not in accordance with the prescribed procedure. Having failed to abide by the prescribed procedure, it is not open to the petitioners to complain of inaction on the part of the District Collector, Nizamabad District, upon their defective Revision Petition.

SK, J WP.No.11102 of 2019 Dt:10.6.2019 The Writ Petition is therefore dismissed on this short ground. This order shall however not preclude the petitioners from filing a proper Revision in accordance with the due procedure. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
