HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1260 OF 2017 O R D E R :

This contempt case is filed alleging violation of order dated 25-01-2017 passed in WP.No.2458 of 2017, wherein this Court directed the Mandal surveyor-4th respondent therein to conduct survey and take action accordingly. Learned Assistant Government Pleader for Revenue basing on the counter affidavit submits that survey could not be undertaken, as sub-division has not been taken place. As such the petitioner was issued endorsement dated 04-04-2017 intimating the same. He also states that as the subject land is not sub-divided, the petitioner has to make an application to the Deputy Surveyor under Section VI-20(b) of B.S.O.34-A of A.P. Board of Revenue Standing Orders for sub-division of the subject land.

Learned counsel for the petitioner submits that endorsement dated 04-04-2017 is not communicated to the petitioner, as such he could not make application for subdivision. The same is disputed by learned Assistant Government Pleader for Revenue and says that the endorsement petition also signed by the petitioner. The said fact is disputed by learned counsel for the petitioner. Survey could not be conducted as there is no subdivision, the contempt case is disposed of directing the respondents to communicate a copy of endorsement dated

04-04-2017 to the petitioner and it is open for the petitioner to make application under B.S.O.34-A as stated supra. On making such application, the respondents are directed to take action in accordance with law.

With the above direction, the contempt case is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this case, shall stand closed.
