THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4984 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.5 seeking grant of anticipatory bail in connection with crime No.32 of 2015 on the file of the Ramapuram Police Station, Y.S.R.Kadapa District, registered for the offence under Section 379 IPC and Section 20(1) of the Andhra Pradesh forest Act and Section 3 of the PDPP Act. Heard and perused the material available on record. The allegation against the petitioner/A.5 is that A.3 in his disclosure statement to the Sub Inspector of Police, Ramapuram, stated that when A.3 was informing about his debts with his brother, A.5 and his uncle advised him that he can earn a lot by doing red sandal business.

He further submits that the petitioner is falsely implicated in the crime due to political rivalry and that he has not involved in any offence as alleged by the prosecution. In the facts and circumstances of the case, this Court is of the view that grant of anticipatory bail will not cause any prejudice to the prosecution. Hence, this Court is inclined to grant anticipatory bail to the petitioner/A.5. The petitioner/A.5 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the Magistrate concerned. Further, the petitioner/A.

5 is directed to report before the Station House Officer concerned daily between 10.00 a.m., and 5.00 p.m., until further orders. It is made clear that if the petitioner/A.5 fails to comply with the condition, the prosecution is at liberty to move an application for cancellation of bail.
