HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15130 OF 2017 ORDER:
The case of the petitioners is that petitioners made three applications dated 16.02.2016 for conversion to the 4th respondent under Section 3 of the Andhra Pradesh Agricultural Lands (Conversion for Non-Agricultural Purposes) Act, 2006 which were taken on file with File No.A2/10352/2016 in respect of different extents of land covered by Sy.Nos.392/U, 392/E, 392/A, 392/AA3, 92/E, 392/EE and 392/AA and the same are not being disposed of. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioners submits that in respect of the very same survey numbers, the 4th respondent granted permission for conversion vide proceedings bearing No.A2/5062/2012 dated 06.05.2013 and A2/4174/2016 dated 13.04.2016, but even though the petitioners' lands are situated in the very same numbers, the 4th respondent is not considering the applications of the petitioners made for grant of permission for conversion of their lands into non-agricultural lands. Heard the learned Assistant Government Pleader for Revenue.
Since the application of the petitioners is stated to be pending before the 4th respondent, the 4th respondent is directed to dispose of the same in accordance with law, by taking into account the above facts and after issuing notice and affording
an opportunity of hearing to the petitioners, within a period of four (04) weeks from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. No order as to costs.
