THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.737 of 2016 ORDER:

This Criminal Petition is filed by the petitioners under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in an unregistered crime.

Heard and perused the material available on record. It is stated that Smt. V. Sujatha, who is the daughter-in-law of petitioners 1 and 2, filed a complaint against the petitioners, and basing on the said complaint, the police called the son of petitioners 1 and 2 and informed that a crime was registered against him and the petitioners.

Learned Public Prosecutor submitted that no crime was registered against the petitioners.

Considering the above submission made by the learned Public Prosecutor, this Court is not inclined to grant the relief prayed by the petitioners. However, the respondent-police concerned are directed to issue notice under Section 41-A Cr.P.C. to the petitioners, if any case is registered against them. If any such notice is served, the petitioners are at liberty to approach this Court for appropriate relief.
