THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38497 of 2016 ORDER:
This writ petition is filed seeking to declare the action of respondents in opening the Rowdy Sheet No.17, dated 30.05.2001, by the 4th respondent and continuing the Rowdy Sheet from the year 2001 onwards, as illegal and arbitrary and consequently to direct the respondents to delete the petitioner's name from the Rowdy Sheet No.17, dated 30.05.2001.
Heard and perused the material available on record. The case of the petitioner is that the 4th respondent has opened a Rowdy Sheet bearing No.17, dated 30.05.2001, and that in any elections conducted by the State and Central Governments, the 4th respondent used to come to the house of the petitioner often and take the petitioner into their custody and that the petitioner is acquitted in all the cases registered by the 4th respondent and now the petitioner is not involved in any other cases since from the year 2007 and the petitioner is working as a Pastor from 2007 onwards without having any remarks from the respondent police.
The grievance of the petitioner is that the petitioner is not involved in any crime, but the 4th respondent, on the basis of the rowdy sheet, is calling the petitioner to the police station every day and whenever there was law and order problem in that area.
Considering the grievance of the petitioner, the petitioner is directed to make a representation to the 3rd respondent informing that he is not involved in any other crime after the year 2001. On such representation, the 3rd respondent is directed to consider and dispose of the same, in accordance with law, as expeditiously as possible, within a
period of one (1) month from the date of receipt of a copy of this order. Until then, the 4th respondent is directed not to call the petitioner to the police station without there being any crime registered against the petitioner for cognizable offence.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
