ORDER:
At the interlocutory stage, the writ petition is taken up for hearing and disposal with the consent of the learned counsel for both the parties.
The writ petition is filed for a mandamus to declare the action of the respondents in cutting the coconut trees' leaves and removing the coconut trees by the side of the puntha situated at Taratava Village, Akiveedu Mandal, West Godavari District, for laying electrical lines as illegal and arbitrary.
In the counter-affidavit filed by respondent No.2, it is, inter alia, stated that laying of electrical line work was completed without cutting the coconut trees; that only some of the ends of the coconut trees' leaves were cut to avoid the interruption of the power supply to the erected 11 K.V. feeder and that the entire work of laying of electrical lines was completed in all respects by 24.12.2010. Ms.Sindhu Gudi, learned counsel representing Mr.K.Chidambaram, learned counsel for the petitioner, submitted that in view of the abovementioned stand taken in the counter affidavit, the writ petition may be closed.
In the light of the above facts and the submission of the learned counsel for the petitioner, the Writ Petition is closed. As a sequel to closure of the writ petition, interim order, dated 09.03.2011 in W.P.M.P.No.1185 of is vacated and W.P.M.P.No.1185 of 2011 and W.V.M.P.No.1511 of 2011 shall stand dismissed as infructuous.
