THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.10139 of 2016 ORDER :

The petitioner, who is accused, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.5 of 2016 of Repalle Town Police Station, Guntur District, registered for the offences punishable under Sections 506 IPC and Section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short "the act").

Heard learned counsel for the petitioner and Public Prosecutor appearing for the respondent-State.

The allegation against the petitioner is that he abused the informant in filthy language by touching his caste. In view of the allegations made and having regard to the bar under the provisions of the Act, I am not inclined to grant anticipatory bail. However, the petitioner is directed to surrender before the Court concerned and move an application for regular bail, after giving prior notice to the public prosecutor concerned, in which event, the same shall be considered on the same day on such terms as the said Court deems fit and proper.
