This arbitration application was filed as long back as in the year 2012 through Mr.Milind G.Gokhale, learned counsel. The said learned counsel expired on 19.12.2018.

On 05.02.2019, when the matter came up for hearing before this Court, Ms.Smitha Shah, learned counsel, sought time on the ground that Mr.Milind G.Gokhale, learned counsel, had expired and she would take instructions from the applicant company.

Today, Ms.Smitha Shah, learned counsel, would state that she could not contact the applicant company as there seems to have been a change of address.

Perusal of the docket reflects that the matter was not even taken up for hearing after December, 2012 till August, 2018, but for one isolated posting in July, 2014.

In the aforestated circumstances, it is clear that the applicant company did not take necessary measures to either pursue this arbitration application or take steps after the death of the learned counsel on record.
